Contract Process

When you have found a property that you wish to buy it is critical that you understand the steps involved in securing the property. We recommend you obtain independent legal advice prior to committing to a purchase.

We can provide you with a copy of the Contract of Sale and/or Vendor Statement as soon as these have been supplied to us by the seller.

Making Your Offer

Prior to making your offer, be certain that the following items have been arranged and are in place:

  • Pre-approved finance (if required) from your bank or lending institution;
  • Your current property sold (if required) or an assessment of value arranged;
  • A solicitor / conveyancer ready to act on your behalf;
  • Your 10% deposit covered and ready;
  • An estimate of the stamp duty payable on your purchase;
  • The value and conditions of any government grant you may be entitled to; and
  • An idea of the settlement terms you need.

You should be aware that the only way to actually buy or sell real estate is through an exchange of signed contracts.  We will ask you to confirm the following details so that we can present your offer to the seller.

  • The price you intend to offer
  • How you will be paying the 10% deposit (cheque, bank transfer, other)
  • The settlement period you need
  • The name of your solicitor or conveyancer
  • Any special conditions or requests you may have

Other Considerations

The cooling-off period allows a buyer time to arrange inspections and reports and to allow the contract details to be checked by their legal advisers. During this period, you will also be protected from:

  • The seller withdrawing from the sale; and 
  • Another buyer coming forward with a higher offer - no further offers can be considered or accepted by the seller during the cooling off period.

Should you decide to delay signing a contract of sale until such time as your legal adviser has had the opportunity to check the contract first, you should be aware that during this time the property remains on the market and anyone else wishing to submit an offer and / or sign a binding contract with the seller is free to do so.

Buying or Selling First ?

Deciding whether to buy or sell first can be a difficult decision however we are here to help and make it easier for you.

  • As a ‘cash buyer’ you are in the best position to negotiate on the purchase price of your new home.
